These Terms & Conditions apply to purchases made through crushedgrape.co.uk and govern the relationship between you and The Crushed Grape when using our website or purchasing goods from us.

Please read these Terms & Conditions carefully before placing an order.

References in these Terms & Conditions to "The Crushed Grape", "we", "us" or "our" refer to Patrick Blake Ltd trading as The Crushed Grape.

References to "you" or "your" refer to the customer purchasing goods from us or using our website.

2. Age Restrictions

We only sell alcoholic products to persons aged 18 or over.

By placing an order containing alcohol, you confirm that you are at least 18 years of age and legally entitled to purchase alcohol.

We reserve the right to carry out age-verification checks before accepting or fulfilling an order.

Our delivery partners may also require satisfactory proof of age or identification before handing over an order.

Where satisfactory proof of age cannot be provided when requested, delivery may be refused.

It is your responsibility to ensure that any person accepting a delivery containing alcohol is legally entitled to do so.

3. Products

We take reasonable care to ensure that product descriptions, photographs, vintages, bottle sizes, prices and other information displayed on our website are accurate.

However, minor variations in packaging, labels, presentation or appearance may occur.

Wine is also a natural product and may develop differently according to its age, storage and individual characteristics.

Product photographs are provided for illustrative purposes and, unless expressly stated otherwise, accessories or presentation materials shown in photographs are not necessarily included.

Where a particular vintage is specified as part of the product description, we will supply that vintage unless we contact you and agree otherwise.

4. Fine & Rare Wines

Fine & Rare wines may have characteristics associated with their age and history.

Where relevant and reasonably identifiable, we may provide information regarding matters such as provenance, storage history, label condition, capsule condition, fill level, original wooden case or other packaging.

Customers purchasing Fine & Rare wines should carefully review the individual product description and any condition information provided before placing an order.

The age of a wine and any condition matters clearly disclosed before purchase will be taken into account when assessing its condition.

We cannot guarantee the drinking condition, flavour, development or future longevity of an individual bottle of mature wine where there is no fault for which we are legally responsible.

Where photographs are stated to be photographs of the actual bottle or case being offered, those photographs form part of the product information.

Nothing in this section limits your statutory rights where goods are faulty or not as described.

5. Prices

All prices displayed on our website are in Pounds Sterling (GBP) and include VAT where applicable unless otherwise stated.

Delivery charges are additional and will be displayed before you complete your purchase.

We take reasonable care to ensure that prices are accurate.

If we discover an obvious pricing or listing error before accepting or dispatching an order, we may contact you to give you the opportunity to purchase the product at the correct price or cancel the affected item and issue a refund.

6. Placing an Order

By placing an order through our website, you are making an offer to purchase the products in your basket subject to these Terms & Conditions.

After placing an order, you will normally receive an automated acknowledgement.

An order acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted it.

A contract for the sale of goods is formed when we accept your order and confirm that it is being processed or dispatched.

7. Our Right to Refuse or Cancel an Order

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including where:

  • A product is unavailable
  • There has been an obvious pricing or product-information error
  • Payment cannot be authorised
  • We reasonably suspect fraud or unauthorised payment activity
  • We cannot satisfactorily verify the customer's age
  • Delivery cannot reasonably be made to the address provided
  • The order would breach applicable law or regulation

Where we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

8. Payment

Payment must be made using one of the payment methods available at checkout.

Payment is subject to authorisation by the relevant payment provider.

We will not be responsible for delays caused by a payment provider declining or delaying authorisation.

You confirm that you are authorised to use the payment method provided when placing your order.

9. Availability

All products are subject to availability.

Some wines, particularly Fine & Rare wines, are available in extremely limited quantities and may consist of a single bottle or case.

Although we take reasonable steps to keep online stock information accurate, an item may occasionally become unavailable after an order has been placed.

If this happens, we will contact you and refund any amount paid for the unavailable item.

10. Delivery

We currently offer online delivery throughout Northern Ireland and Great Britain.

Delivery charges are calculated according to the size and weight of the order and are displayed at checkout before payment.

Our standard delivery timeframe is normally 2–4 business days.

Delivery dates and times are estimates unless we expressly agree otherwise.

We remain responsible for goods while they are being delivered to you as required by applicable law.

You are responsible for providing a complete and accurate delivery address.

If an order cannot be delivered because inaccurate or incomplete information has been provided, or because no eligible recipient is available to accept an age-restricted delivery, additional reasonable delivery costs may apply where a further delivery is requested.

11. Republic of Ireland

We do not currently offer online delivery to the Republic of Ireland.

Customers from the Republic of Ireland may place eligible orders for collection from our Derrylin store where the collection option is available at checkout.

Please wait until we have confirmed that your order is ready before travelling to collect it.

We may request order confirmation and suitable identification when an order is collected.

Proof of age may also be required for alcohol purchases.

13. Damaged Goods

We use specialist protective packaging when preparing products for delivery.

If your order arrives damaged, please contact us as soon as reasonably possible at hello@crushedgrape.co.uk.

Please retain the affected goods and all relevant packaging and, where possible, provide photographs of:

  • The damaged product
  • The protective packaging
  • The external packaging
  • The delivery label

This information assists us in investigating the damage and making any necessary claim with our delivery provider.

Where goods have been damaged in transit, we will provide the appropriate remedy in accordance with your legal rights.

14. Your Right to Cancel an Online Order

Where the statutory right to cancel applies, consumers purchasing online generally have 14 days after receiving their goods to notify us that they wish to cancel the contract without giving a reason.

After notifying us of cancellation, the goods must be returned within the applicable statutory period.

Unless goods are faulty, damaged or incorrect, you are responsible for the cost of returning them to us.

You are responsible for taking reasonable care of goods while they are in your possession.

We may make a deduction from a refund where permitted by law if the value of the goods has been reduced as a result of handling beyond what is necessary to establish their nature, characteristics and functioning.

Certain statutory exceptions to cancellation rights may apply to particular products or circumstances.

Nothing in these Terms & Conditions provides an additional or extended change-of-mind returns policy beyond your legal rights.

15. Faulty or Misdescribed Goods

Products supplied by us must meet the standards required by applicable consumer law, including being of satisfactory quality, fit for purpose and as described.

If you believe a product is faulty, damaged or materially different from its description, please contact us.

Nothing in these Terms & Conditions limits or excludes your statutory rights.

16. Refunds

Where a refund is due, it will normally be made to the original payment method.

We may withhold a refund for returned goods until we have received the goods back or you provide appropriate evidence that they have been returned, where permitted by law.

The time taken for a refund to appear in your account after we have processed it may depend on your bank or payment provider.

17. Title and Risk

Ownership of goods will pass to you once we have received payment in full.

For consumer deliveries, risk in the goods passes to you when the goods come into your physical possession or the possession of a person identified by you to receive them, subject to applicable law.

18. Promotions and Discount Codes

Promotional offers and discount codes may be subject to additional terms.

Unless expressly stated otherwise:

  • Promotions cannot be exchanged for cash
  • Discount codes cannot be applied retrospectively
  • Only one discount code may be used per order
  • Promotions are subject to availability
  • We may withdraw or amend a promotion where reasonably necessary

Any additional conditions applying to a particular promotion will be communicated with that promotion.

19. Website Information

We take reasonable care to ensure information on our website is accurate and up to date.

However, we do not guarantee that the website will always be available, uninterrupted or free from technical errors.

We may update, modify or temporarily withdraw parts of the website where reasonably necessary.

20. Intellectual Property

The content of this website, including our branding, text, graphics, photographs, design and other materials, is owned by or licensed to The Crushed Grape or Patrick Blake Ltd unless otherwise stated.

Content may not be copied, reproduced, distributed or used for commercial purposes without prior permission, except where permitted by law.

21. Liability

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

We are responsible for losses that are a foreseeable result of our breach of these Terms & Conditions or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Where you are purchasing as a consumer, we are not responsible for business losses, including loss of profit, revenue, business opportunity or business interruption arising from a consumer purchase.

Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

22. Events Outside Our Reasonable Control

We will not be responsible for delay or failure to perform our obligations where this results from circumstances genuinely outside our reasonable control.

Where such circumstances materially affect an order, we will take reasonable steps to minimise the effect and will contact you where appropriate.

Your statutory rights are not affected.

We process personal information in accordance with our Privacy Policy.

Please refer to our Privacy Policy for information about what personal information we collect, why we use it, who we share it with and your data protection rights.

24. Changes to These Terms

We may update these Terms & Conditions from time to time.

The Terms & Conditions applying to an order will normally be those in force at the time that order was placed.

The latest version will be published on our website together with the date it was last updated.

25. Severability

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the extent necessary without affecting the remaining provisions.

26. Governing Law

These Terms & Conditions are governed by the applicable laws of Northern Ireland.

If you are a consumer resident elsewhere in the United Kingdom, you will also retain the benefit of any mandatory consumer protections that apply to you.

Nothing in these Terms & Conditions affects any rights you may have regarding where legal proceedings may be brought under applicable law.
